Indian Parliament Resolution on Kashmir-22nd February 1994

On 22nd February 1994, Indian parliament unanimously passed a resolution in regard to Kashmir.

Notes with deep concern Pakistan’s role in imparting training to the terrorists in camps located in Pakistan and Pakistan Occupied Kashmir, the supply of weapons and funds, assistance in infiltration of trained militants, including foreign mercenaries into Jammu and Kashmir with the avowed purpose of creating disorder, disharmony and subversion: reiterates that the militants trained in Pakistan are indulging in murder, loot and other heinous crimes against the people, taking them hostage and creating an atmosphere of terror; Condemns strongly the continued support and encouragement Pakistan is extending to subversive and terrorist activities in the Indian state of Jammu & Kashmir; Calls upon Pakistan to stop forthwith its support to terrorism, which is in violation of the Simla Agreement and the internationally accepted norms of inter-State conduct and is the root cause of tension between the two countries reiterates that the Indian political and democratic structures and the Constitution provide for firm guarantees for the promotion and protection of human rights of all its citizens; regard Pakistan’s anti-India campaign of calumny and falsehood as unacceptable and deplorable; notes with deep concern the highly provocative statements emanating from Pakistan; urges Pakistan to refrain from making statements which vitiate the atmosphere and incite public opinion; expresses regret and concern at the pitiable conditions and violations of human rights and denial of democratic freedoms of the people in those areas of the Indian State of Jammu and Kashmir, which are under the illegal occupation of Pakistan;

On behalf of the People of India, Firmly declares that – (a) The State of Jammu & Kashmir has been, is and shall be an integral part of India and any attempts to separate it from the rest of the country will be resisted by all necessary means; (b) India has the will and capacity to firmly counter all designs against its unity, sovereignty and territorial integrity; and demands that – (c) Pakistan must vacate the areas of the Indian State of Jammu and Kashmir, which they have occupied through aggression; and resolves that -(d) all attempts to interfere in the internal affairs of India will be met resolutely.” The Resolution was unanimously adopted.

Out of 2,22,236 sq kms of the J&K state, Jammu has 26,293 sq kms and Ladakh 1,38,942 sq kms. It must be remembered that 78,114 sq kms of the state is under illegal occupation of Pakistan, 37,555 sq kms under illegal occupation of China and 5,180 sq kms have been illegally handed over to China by Pakistan. While Ladakh constitutes 69.60 % of the state’s total land area, Kashmir valley, the turbulent one is just 11.48 % and Jammu 18.92 %.  Also, Pakistan has offered the entire region of Gilgistan-Baltistan to China. A rail link is now under construction from Tibet to join the Pakistan rail network and connect to Gwadar port. Permanent military barracks have been constructed for increasing numbers of Chinese troops. This region is an important link in China’s String of Pearls strategy to contain India. We demand Indian government to re-conquer the POK. It will be decisive blow to security threat to Republic of India from Communist-Islamist alliance. It is also necessary to fulfil energy needs of India’s growing economy by opening direct routes to oil & gas rich Central-Asia.

Facts on POK (Pak Occupied Kashmir)

–         Over 10 lakh refugees from POK resulting out of 1947 partition are not permanently settled till date. They are still living in refugee camps in the most inhuman conditions.

–         Over 4 lakh West Pakistan refugees don’t have basic constitutional rights even after 64 years.

–         Pakistan’s occupation of Mirpur, Muzzaffarabad, Gilgit-Baltistan and major areas of Poonch is illegal and forceful and intolerable.

–         In 1994, Pakistan’s Supreme Court upheld the Muzaffarabad High Court’s decision that Northern Areas (Gilgit & Baltistan) are NOT a part of Azad Jammu & Kashmir (POK), but part of Jammu and Kashmir.

–         POK is not included in Pakistan’s constitution and hence there is no fundamental guarantee of civil rights or democratic representation for various civil services.

–         Nearly 70% of POK’s population work as daily wage laborers. 75% do not have any food security.

–         Raskam & Shaksgam valley of Baltistan region were illegally ceded by Pakistan to China in 1963. Latest news is that Pakistan proposes to lease areas of Gilgit to China for 50 years.

– Pakistan has substantially changed the demography of POK and attempts are under way to do the same in Gilgistan-Baltistan. Shia majority of the area is being routinely terrorized by Pak army backed Sunni Islamist groups. Forced conversion, abduction of girls has reached alarming new height.

Demands to the Government of India

–         Act on the parliament resolution of Feb 22, 1994. Ask Pakistan and China to vacate the illegally occupied areas of Jammu & Kashmir.

–         Provide basic constitutional rights to West Pakistan refugees who migrated during the partition of 1947.

–         West Pakistan & POK refugees should be given reservation in education and employment in the state of J&K.

–         35 % of POK population lives as refugees in J&K. 24 seats belonging to POK area are vacant in J&K assembly today. We demand permanent registration for POK refugees and representation in assembly and parliament.

–         Resettlement of over 5 lakh refugees and their children from Jammu & Kashmir who were victims of terrorism.

–         Force Pakistan to stop forthwith its support to terrorism, which is in violation of the Shimla Agreement and the internationally accepted norms of inter-State conduct.
